Swayli

Terms of Use

Last updated: October 18, 2026

Swayli helps you return to a place, line up a new shot, and keep a visual record of change. These Terms of Use cover the app, your account, and the photos and spot records you manage with it. Swayli operates the service ("we," "us," or "our"). Creating an account or using the app means you accept these terms. Please stop using Swayli if you do not accept them.

Your photo series live on this iPhone. Before changing devices, removing the app, or deleting your account, save the images and records you want to keep.

1. Using the app

Swayli accounts are for people aged 18 or older who can enter into a binding agreement. You may use the app for lawful purposes under a limited, non-exclusive, non-transferable license, subject to these terms and the rules of your download platform.

The app, its design, and Swayli branding belong to us or the relevant licensors. Do not reproduce or distribute them without permission, except where the law or an applicable license allows it. The iOS app also uses Apple's Standard Licensed Application End User License Agreement where applicable; these service terms do not replace that license or reduce your mandatory consumer rights.

2. Your photos, places, and responsibilities

Photos you capture or import, together with your spot names, notes, and other content, remain yours. Swayli needs only the permission required to carry out the features you request: processing images on your phone, keeping your account details and uploaded profile photo, and preparing exports. You do not give us ownership of your content or permission to use your spot photos in our advertising.

Before photographing people, entering private property, or sharing an image, make sure you have any permission required by law. A comparison image can reveal a person, a home, or a location even without location metadata. Respect privacy, copyright, access restrictions, and other people's safety. Do not use Swayli for stalking, harassment, exploitation, impersonation, or unlawful content.

3. Keeping a photo series on this iPhone

Spots, photo series, reference-photo choices, and related settings are kept in a local library for each account. Swayli does not automatically upload or synchronize this library to our servers.

4. Taking, exporting, and sharing photos

Reference overlays, alignment tools, light hints, nearby distances, routes, and reminders help you plan a retake. Their results depend on device readings, permissions, operating-system limits, and other conditions. Check the scene and your surroundings yourself; these tools do not establish that a location is safe or accessible and are not surveying or professional advice. Do not take photos while driving or put yourself or others at risk to match an earlier shot.

Saving to Photos or using the system share sheet creates a copy outside Swayli. Backup produces an unencrypted ZIP containing photos and spot records, which can include precise coordinates, notes, and dates. It is an export, with no in-app restore or automatic device migration. Choose its recipients and storage location carefully. You control the copies you save or share, together with the destination service.

5. Signing in and using online services

Sign in with Apple or use an email address and password. The email entry can create a new account or sign you in to an existing one. Keep your details accurate and your credentials secure. Do not access another person's account without authorization. You are responsible for activity under your account except to the extent caused by our failure to meet our legal obligations; tell us if you suspect unauthorized access.

The Privacy Policy, available on the welcome screen and in Me, describes account uploads, system services, notifications, and measurement. Camera, Photos, location, notification, and tracking permissions can be managed in iOS Settings. A declined permission can make the related feature unavailable. Apple services, sharing destinations, and external websites have their own terms and privacy notices; we remain responsible for our obligations when using service providers.

6. Closing your account and removing data

To delete your account, open Me → Delete account and confirm while connected to the internet. If the request fails, deletion has not been confirmed; you can retry, signing in again if needed. After the server reports successful deletion, the app ends the session and begins removing that account's local library. Cleanup can finish on a later launch if it is interrupted; the app is designed to retry unfinished cleanup.

Account deletion does not remove photos saved to Photos, exported ZIP files, shared images, or independent device backups. You must manage those copies at their destinations. Signing out or uninstalling Swayli does not itself delete the server account. The Privacy Policy explains retention of online records; email us if you need deletion help or cannot sign in.

7. Availability, misuse, and legal protections

Do not attack the service, steal credentials, bypass security controls, or misuse our infrastructure. For a material breach, unlawful activity, a security threat, or a legal requirement, we may take proportionate steps to restrict or end access. When appropriate and legally permitted, we will give notice and an opportunity to address the issue. Contact us if you believe a restriction is mistaken.

We work to keep Swayli reliable, but availability, reminders, and local data recovery cannot be guaranteed. Features may change or stop being available; we will give notice of a material reduction where reasonably practicable. Insofar as the law allows, the service is provided "as is" and "as available," and we exclude liability for indirect or consequential losses. These limitations leave intact liability and remedies that cannot legally be excluded, including mandatory consumer rights and applicable protection against fraud, willful misconduct, or gross negligence.

8. Updates, questions, and disputes

The date above identifies this version. If these terms change, we will update it and provide any additional notice or obtain any agreement required by law. If you no longer accept the terms, stop using Swayli and save the local content you wish to keep.

Send support questions, account requests, or concerns to support@swayliapp.com. Describe the issue without sharing passwords or authentication tokens. We will try to resolve it with you; your access to courts, regulators, and remedies under applicable law is preserved.
